These Terms and Conditions set out the basis on which Rubbish Removal Elephant and Castle provides rubbish removal and waste collection services within its service area. By booking a collection, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
In these Terms and Conditions, the following expressions shall have the meanings set out below:
Customer means the person, business, organisation, or other entity requesting the services of Rubbish Removal Elephant and Castle.
Services means any rubbish removal, waste collection, clearance, loading, transport, and associated services provided by Rubbish Removal Elephant and Castle.
Waste means items, materials, or substances that the Customer wishes to dispose of and that Rubbish Removal Elephant and Castle agrees to remove as part of the Services.
Contract means the agreement between the Customer and Rubbish Removal Elephant and Castle for the provision of Services, incorporating these Terms and Conditions.
Rubbish Removal Elephant and Castle provides waste collection and rubbish removal services for residential, commercial, and other premises within its operational area. Services typically include attendance at the location agreed with the Customer, loading of Waste into a suitable vehicle, and transportation of the Waste to an authorised disposal, recycling, or treatment facility.
The specific details of the Services, including date, time window, estimated quantity of Waste, and quoted price, will be agreed at the time of booking. The Customer is responsible for providing accurate information about the type and volume of Waste and the access conditions at the collection address.
3.1 Bookings may be made by telephone, email, or through any other communication method accepted by Rubbish Removal Elephant and Castle from time to time.
3.2 When requesting a booking, the Customer must provide:
a. Full name and contact details.
b. Collection address and any relevant access instructions.
c. Description of the Waste, including estimated volume, type of materials, and any items that may be hazardous or heavy.
d. Preferred date and time window for collection.
3.3 Any quoted price will be based on the information provided by the Customer at the time of booking. Quotes may be subject to change if, on arrival, the actual volume, weight, or type of Waste differs from that described, or if access conditions are significantly more difficult than stated.
3.4 A booking will be considered confirmed only when Rubbish Removal Elephant and Castle has acknowledged acceptance and, where applicable, has received any required advance payment or deposit.
4.1 The Customer must ensure that Rubbish Removal Elephant and Castle has safe and reasonable access to the Waste at the agreed time. This includes arranging any necessary permissions, parking suspensions, gate codes, or entry passes.
4.2 The Customer must ensure that the Waste is clearly identified and, where possible, segregated or grouped in an accessible location. The Customer must remove or secure any personal or valuable items that are not intended to be taken as Waste.
4.3 Where the Services are provided inside a property or building, the Customer is responsible for ensuring that the route to the Waste is clear and safe, and that any known risks or hazards are disclosed in advance.
4.4 If the crew considers that the collection cannot be carried out safely or legally, Rubbish Removal Elephant and Castle may refuse to perform all or part of the Services. In such cases, any reasonable call-out or waiting charges may still apply.
5.1 Rubbish Removal Elephant and Castle is not obliged to remove any item that it reasonably believes to be hazardous, illegal, or not permitted for collection under applicable waste regulations or licence conditions.
5.2 Restricted items may include, but are not limited to, asbestos, clinical or medical waste, chemical waste, flammable substances, gas bottles, pressurised containers, and certain types of electrical or electronic equipment, unless expressly agreed in advance.
5.3 The Customer must declare any items that may be hazardous, awkward to handle, excessively heavy, or likely to cause damage during removal or transport. Failure to do so may result in additional charges or cancellation of the Services.
5.4 Rubbish Removal Elephant and Castle may, at its sole discretion, remove some restricted items subject to applicable regulations and additional charges, provided that prior agreement is obtained from the Customer.
6.1 Prices for the Services are generally based on the volume and type of Waste, the time required for loading, the number of operatives, and any special handling or access challenges.
6.2 Any quoted price is an estimate based on the information provided prior to the visit. On arrival, the crew will assess the Waste and confirm the final price with the Customer before commencing loading. If the Customer does not agree to the revised price, the crew may cancel the collection and a call-out charge may apply.
6.3 Unless otherwise agreed in writing, payment is due in full on completion of the collection and prior to departure of the crew from the site. Payment may be made by cash, card, bank transfer, or any other accepted method notified to the Customer.
6.4 For business Customers or regular service agreements, payment terms may be agreed separately. If no specific terms are agreed, invoices are payable within 14 days of the invoice date.
6.5 Rubbish Removal Elephant and Castle reserves the right to charge interest on overdue amounts at the statutory rate, as well as reasonable costs of debt recovery.
7.1 The Customer may cancel or reschedule a booking by providing reasonable notice. Unless stated otherwise, cancellations or changes made at least 24 hours before the agreed time will not incur a cancellation fee.
7.2 Cancellations made less than 24 hours before the agreed time may incur a cancellation charge to cover lost time and scheduling costs. This may be up to a reasonable proportion of the quoted fee, or a flat call-out charge.
7.3 If the crew attends the collection address at the agreed time and is unable to gain access or unable to carry out the Services for reasons within the Customer's control, Rubbish Removal Elephant and Castle may treat the booking as cancelled and may charge a failed attendance fee.
7.4 Rubbish Removal Elephant and Castle reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including vehicle breakdown, adverse weather, traffic disruption, staff illness, or compliance with legal obligations. In such cases, the Customer will be offered the next available appointment and any prepayments will be applied to the rearranged booking or refunded if no alternative can be agreed.
8.1 Any times or dates given for attendance and completion of the Services are estimates only and are not guaranteed, although reasonable efforts will be made to meet agreed time windows.
8.2 Rubbish Removal Elephant and Castle shall not be liable for any loss, damage, or expense arising from delay or failure to perform the Services where such delay or failure is due to circumstances beyond its reasonable control.
9.1 The Customer warrants that they have the authority and right to dispose of the Waste and that the Waste does not include any items belonging to third parties without appropriate consent.
9.2 Once Waste has been loaded onto the vehicle and the Customer has confirmed that the collection is complete, items will not normally be retrieved. The Customer is therefore responsible for checking that no personal property or important documents are inadvertently included in the Waste.
10.1 Rubbish Removal Elephant and Castle will handle, transport, and dispose of Waste in accordance with applicable UK environmental and waste management legislation and any relevant local regulations.
10.2 Waste will be taken to authorised transfer stations, recycling facilities, or disposal sites. Reasonable efforts will be made to divert suitable materials from landfill by recycling or re-use where possible.
10.3 Where required, Rubbish Removal Elephant and Castle may issue or retain appropriate documentation relating to the transfer of Waste, such as waste transfer notes for non-hazardous waste. Business Customers agree to provide any information reasonably requested to complete such documentation.
10.4 The Customer agrees not to request the removal or disposal of Waste in any manner that would breach relevant legislation or environmental regulations.
11.1 Rubbish Removal Elephant and Castle will exercise reasonable care and skill in providing the Services. However, minor scuffs, marks, or incidental damage may occur where items are large, heavy, or difficult to access. The Customer is encouraged to point out any particularly delicate surfaces or items before work commences.
11.2 Rubbish Removal Elephant and Castle shall not be liable for any pre-existing damage or defects to the property or items being removed, nor for deterioration or damage arising from the inherent nature of the items or materials handled.
11.3 To the fullest extent permitted by law, Rubbish Removal Elephant and Castle shall not be liable for:
a. Any indirect, consequential, or economic loss, including loss of profit, business, or opportunity.
b. Any loss or damage arising from inaccurate or incomplete information provided by the Customer.
c. Any loss arising where the Customer has failed to take reasonable steps to safeguard personal or valuable items.
11.4 Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited or excluded.
11.5 In any event, and to the extent permitted by law, the total liability of Rubbish Removal Elephant and Castle in respect of any claim arising out of or in connection with the Services shall not exceed the total price paid or payable for the specific collection giving rise to the claim.
12.1 Rubbish Removal Elephant and Castle maintains appropriate insurance cover for its activities, including public liability insurance, in accordance with industry standards.
12.2 Details of insurance cover may be made available on request. The existence of insurance does not extend or increase liability beyond the limits set out in these Terms and Conditions.
13.1 Any concerns or complaints about the Services should be raised as soon as possible, preferably at the time of collection or within a reasonable period thereafter.
13.2 The Customer should provide details of the issue, including dates, times, location, and any supporting evidence. Rubbish Removal Elephant and Castle will investigate and seek to resolve the matter promptly and fairly.
13.3 Any claim relating to alleged loss or damage must be notified within 7 days of the Services being carried out, failing which the ability to investigate and resolve the issue may be prejudiced.
14.1 Rubbish Removal Elephant and Castle will handle personal data in accordance with applicable data protection laws and will only use Customer information for legitimate business purposes such as processing bookings, performing the Services, invoicing, and, where appropriate, service-related communications.
14.2 Personal data will not be sold to third parties. It may be shared with trusted partners or service providers where necessary to deliver the Services or comply with legal obligations.
15.1 Rubbish Removal Elephant and Castle reserves the right to amend or update these Terms and Conditions from time to time. The version in force at the time of booking will apply to the corresponding Contract.
15.2 Any specific variation or additional term agreed in writing with the Customer shall prevail over these general Terms and Conditions to the extent of any inconsistency.
16.1 If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable by a court or other competent authority, such provision shall be deemed severed from the remainder, which shall continue in full force and effect.
17.1 These Terms and Conditions, and any Contract formed under them, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Services or these Terms and Conditions.
18.1 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the Customer and Rubbish Removal Elephant and Castle in relation to the Services. They supersede any prior understandings, statements, or representations, whether oral or written.
18.2 The Customer acknowledges that they have not relied on any representation or warranty not expressly set out in these Terms and Conditions and that they have had the opportunity to ask questions and seek clarification before entering into the Contract.
